Preamble

The Hacking Project believes that education should be easily accessible and open to all. The Hacking Project's mission is to offer free training based on a self-directed, project-based learning model. We firmly believe in preserving our Participants' freedom of expression. We also want to ensure that all our Participants and teachers feel safe and comfortable when participating in our Training. We have established these guidelines so that people understand and respect the rules for participating in our community and in our Training in general.

We do not systematically filter or monitor content provided by Participants, but we may remove or modify inappropriate content or activity that has been reported to us, or suspend, disable, or terminate a Participant's access to all or part of the Training.

As part of our Training, you are prohibited from sharing content that:

  • Contains illegal content or encourages illegal activities with the intent to commit such activities. Please remember that the minimum age for Participants in The Hacking Project is 15, and we do not allow content that is inappropriate for Participants of that age.
  • Contains credible threats or organizes acts of violence in the real world. We do not allow content that creates a real risk of injury or property damage, that plausibly threatens individuals or public safety, or that organizes or promotes violence.
  • Harasses others. We encourage comments on people and issues of public interest, but content that is insulting or otherwise inappropriate to private individuals is not permitted.
  • Violates intellectual property, privacy, or other rights. Do not share content that you do not have the right to share, claim as your own content that you did not create yourself, or infringe upon or otherwise misappropriate the intellectual property rights or other rights of another person. Always attribute content that you use or quote to its original copyright owner.

Part I - Contractual Framework

Article 1 – Purpose

THP offers professional distance learning courses in the fields of web and digital development. Access implies unconditional acceptance of the Terms of Use.

Article 2 – Acceptance of the Terms of Use

By participating in the Training, you agree to be bound by these Terms, including the policies referenced herein. If you disagree with any part of these terms, you must not participate in the Training.

Article 3 – Modification of the Terms of Use

We reserve the right to modify these Terms for legitimate reasons, such as:

  • adaptation to legal or regulatory changes,
  • improving or modifying our services,
  • the addition or conclusion of a new partnership that may affect the content, terms, or conditions of the Training.

Any substantial modification will be notified by email or via our platform at least 15 days before it comes into effect. In the event of disagreement, you may cancel your registration or your use of our services free of charge before this date. An archive of all versions of these Terms and Conditions will be available for consultation.

Article 4 – Access to training

The Hacking Project Training is open to any individual over the age of 15 with no prerequisites in terms of technical knowledge or professional experience. Parental consent is required for minors over the age of 15.

Article 5 – Legal conditions of participation

You may participate in our Training if you have the legal capacity to enter into a contract with The Hacking Project. When you register, you must provide us with accurate and complete information, and you agree to modify your information so that it remains accurate and complete.

Article 6 – Student's contractual commitments

  • Provide accurate information when registering.
  • Use only one personal account to access the Training Program.
  • Comply with the internal rules and policies of the Training Program.
  • Actively participate in the Training and group projects.
  • Provide constructive feedback and respect the community.

Part II – Pedagogical functioning

Article 7 – Mentors and Ambassadors

Volunteer mentors with no obligation to achieve results. Freelance ambassadors who are remunerated and have no educational responsibility.

Article 8 – Assessment and Certification

  • RNCP Level 5 diploma issued by Webecom.
  • Micro-certifications issued via the Intuition protocol. References and reports based on the educational calendar.
  • References and reports based on the educational calendar.
  • No university credits are awarded.

Article 9 – Deblock/Gnosis Account & Rewards

The creation of a Deblock account (Europe) and a Gnosis account (Everyone) is mandatory to access rewards (THP for Good campaign via our partner fablab.box). Article 10 – Intellectual Property and Third-Party Services The use of the Services may involve the use of third-party services. The Services are provided "as is" and "as available."   • THP content may only be downloaded for personal, non-commercial use.
  • Ownership of uploaded projects: each participant is responsible for their own content.
  • Use of third-party tools under their own license (GitHub, hosting services, etc.).
  • Mandatory compliance with third-party intellectual property rights.
  • THP declines all responsibility for the use of or violations related to third-party content or services.

Part III – Image rights and promotion

Article 11 – Public promotion & Image rights

By accepting these Terms of Use, the Participant authorizes The Hacking Project to use, for promotional or educational purposes, all or part of the productions, videos, screenshots, recordings of courses or hackathons, photographs, interviews, quotes, or other content that they have created or in which they appear during the training. This authorization is granted free of charge and without time limitation, for any existing or future media, worldwide.

In case of refusal, the Participant may at any time send an explicit request for withdrawal to the following address:

The request will be processed within a reasonable time frame.

In accordance with the General Data Protection Regulation (GDPR), the Participant has the right to access, rectify, and delete their personal data, including with regard to their image rights.

Part IV – Payment and financial obligations

Article 12 – Course fees

The training is free for the first three weeks. At the end of this period, if the student wishes to continue, they must choose one of the financing options offered, or obtain a THP for Good scholarship. In the event of withdrawal without legitimate justification after this period, a fee of €500 may be charged to compensate for the place reserved.

Article 13 – Payment terms

Payment for the training program can be made:

  • By personal payment (payment in one or more installments via Stripe or bank transfer).
  • By CPF or OPCO.
  • By solidarity funding (THP for Good scholarships or partner grants).

Article 13.bis: Financing

Payment in one installment or in installments (up to 4 monthly payments with no fees).

  • 1st payment: 30% before training.
  • 2nd payment: 4 weeks later.
  • 3rd payment: 8 weeks later.
  • 4th payment (if applicable): 12 weeks after.

Part V – Responsibilities, disputes, and applicable law

Article 14 – Withdrawal and refund

Students have a legal withdrawal period of 14 days from the date of signing the contract. After this period, no refunds can be claimed, except in cases of duly justified force majeure. Refund requests must be sent to:

Article 15 – Limitation of liability

The Hacking Project cannot be held liable for any direct or indirect damage resulting from the use of the training, including in the event of error, omission, service interruption, or data loss. THP's liability is in any case limited to the amount actually paid by the student.

Article 16 – Service Availability

We make every effort to ensure continuous access to the training platform. However, temporary interruptions may occur for maintenance, updates, or other technical reasons. No compensation may be claimed in the event of temporary unavailability.

Article 17 – Force majeure

THP cannot be held liable in the event of force majeure as defined by French case law, including in particular in the event of war, natural disaster, strike, pandemic, failure of digital service providers, or interruption of communication networks.

Article 18 – Personal data

The Hacking Project collects and processes personal data in accordance with the General Data Protection Regulation (GDPR). The data is used solely for educational, administrative, or legal purposes and is never transferred to third parties without prior consent.

Article 19 – Cookies and third-party tools

The platform may use technical cookies to ensure its proper functioning, as well as third-party tools (e.g., Google Analytics) for statistical purposes. By continuing to browse the site, the user accepts the use of these tools. The user may configure their browser at any time to refuse all or some cookies.

Article 20 – Applicable law and dispute resolution

These Terms of Use are governed by French law. In the event of a dispute, an attempt at amicable resolution will be preferred. If no solution is found, the French courts will have sole jurisdiction.

Article 21 – Indivisibility of clauses

If any provision of these Terms of Use is declared invalid, illegal, or unenforceable, this shall not affect the validity of the other provisions, which shall remain in full force and effect.

Article 22 – Entire agreement

These Terms and Conditions of Use constitute the entire agreement between the Student and The Hacking Project regarding their participation in the Training. They supersede all prior or contemporaneous agreements, written or oral, relating to the subject matter hereof.
